You cannot get PR based on LMIA only. However, it can be used to support an application for permanent residency (PR) in Canada through specific immigration programs, such as the Express Entry system. Under the immigration program, a positive LMIA can help you get 50 or 200 points for certain senior positions. If you get job offers under National Occupational Classification (NOC) TEER categories 1, 2, and 3, then you will be awarded 50 CRS points. On the other hand, you will get 200 additional points if you get a job offer under NOC TEER category 0
LMIA is valid for up to 6 months. During this period, the Canadian employer must notify the temporary foreign worker (TFW) that the LMIA was approved and send them a positive LMIA letter.
However, Employment and Social Development Canada (ESDC)/Service Canada assesses the job’s duration based on the LMIA application. Depending on the individual’s case, the Canadian government can decide the duration of the LMIA work permit.
The employer in Canada will apply for an LMIA for you by submitting an application to Employment and Social Development Canada (ESDC). This includes demonstrating that efforts were made to hire Canadians, providing details of the job offer, and paying the required fee. The LMIA processing time varies depending on the type of job and location, but it typically ranges from a few weeks to up to 3 months. However, specific applications under the Global Talent Stream (GTS) are processed within 10 business days.
